Top up transmission oil. (Transmission oil has been drained)

Remove M10 oil drain plug (1) from transmission oil sump.
Pour in automatic transmission fluid through oil filler plug until oil emerges at oil drain plug.
Start engine and run at idle speed.
Check whether ATF emerges at M10 oil drain plug.
If not, continue to add ATF.
Actuate footbrake and at idle shift through all gears "P" to "D" twice for more than 2 seconds.
Then move switch to "P" position.
Again check whether ATF emerges at M10 oil drain plug.
Check the temperature of the automatic transmission fluid with the BMW Diagnosis System.
Increase temperature of automatic transmission fluid to 35 ... 45 °C.
Top up automatic transmission fluid until it flows over.
Screw in oil filler plug and oil drain plug.

I'm using the Valvoline ATF Max Life.  Its JWS 3309 Aisin Warner Approved.  $20 per gallon vs $20/qt.  Its working awesome now that I better understand how to get the level correct in the transmission.  Just driving for 1000 miles and then another change.  After that, one more change at 1000 miles, but with a new Separator Screen (Trans filter).

Did you use the MINI factory trans fluid or other?

A follow up.
I had been shutting off the car after shifting from P to D and checking the fluid level. Still had the hard cold shifting, even up in the air. So, I left the car running and ended up adding almost another quart and a half at 122 degrees on my scan tool. I hope this is correct because it shifts completely different in the air (super smooth) and I haven't test drove it yet. Hoping that someone yells STOP before I damage the transmission.
I am almost thinking that is was very low on fluid in the first place that accounted for the funky shifting prior to the service.
Any input would be appreciated.

I have a 2008 R56 non-turbo, auto transmission with 79K miles.  In the process of getting this car all repaired and up-to-date, the last challenge was servicing the transmission. 
I have the Bentley Manual and followed the steps.  I did not R & R the Trans Filter.  I am saving that for the 3 fluid change. 
The drained fluid was just under 2 quarts in volume.  It was very dark, but not burnt.  It actually smelt very good for overused ATF.  I replaced the fluid and it actually took just over 2-1/4 quarts to complete the service.  (I had a slight learning experience with filling and starting the car with the fill plug removed.  "Old Faithfull", if you know what I mean.)

Prior to changing the fluid, I was experiencing late shifts, delayed rolling shifts and it just didn't feel good. 
Warmed up with the new fluid, it shifts very smooth and crisp.  Its actually a delight to drive.

Cold, its horrible.  Hard shifting and hard downshifting when on the brake.  

I had planned to change the fluid again in about 1K to 2K miles and again with the filter after another 1K-2K miles.  I want to try and work out the old and blend in as much new fluid as possible. 

Has anyone experienced the hard cold shifting after a fluid change? Does it go away or should I be concerned?  Any suggestions?
